Notice of Student and Family Rights Under NY Education & Immigration Law 3201
Dear NECSD students and families,
Every child in Newburgh has the right to a free public education, no matter where they or their family were born and no matter their immigration or citizenship status. A New York State law, Education Law §3201-b, adds new protections for immigrant students and families starting this school year. We want you to know what those protections are and what our schools will do to keep your children safe.
Your child can enroll and take part in school
- Your child can enroll in school no matter their immigration or citizenship status.
- Enrollment and class placement will not be delayed because of status.
- Your child can take part in all school programs and activities.
- As a parent or guardian, you have the same right to take part in your child’s school as every other family.
We protect your family’s information
- Our staff will not ask about your or your child’s immigration or citizenship status, nationality or
country of origin, except in limited cases such as when you apply for a public program or benefit. - We will not share information about your family’s immigration status with immigration authorities unless a federal judge has issued a court order or warrant.
- We will not share your family’s personal information, such as addresses, phone numbers or medical information, with immigration authorities except as required by a court.
- Immigration status is never part of the “directory information” that schools may release.
If immigration agents come to a school
- Staff will not let immigration agents into non-public areas of a school, question your child or take your child, unless a judge has signed a warrant or court order and our school attorney has reviewed it.
- Administrative immigration warrants, detainers and “notices to appear” are not enough.
- School staff, including School Resource Officers, will not help immigration agents find, question or detain students.
- We will tell you right away if immigration authorities ask about your child or about you, unless a court order prevents us.
If you cannot pick up your child
If a parent or guardian is detained, or no one comes to pick up a child, your child will stay safely at school with staff. We will call every emergency contact you have given us before we contact any outside agency.
How you can help
Please keep your emergency contacts up to date. List more than one trusted adult who can pick up your child. You can update this information at any time through your child’s school main office.
Questions?
Please contact your child’s school principal. Information is available in other languages. Just ask your child’s school.
Thank you for being part of our school community.
Sincerely,
Dr. Jackielyn Manning Campbell
Superintendent of Schools
Newburgh Enlarged City School District
